Terms of Service

Domitienda

These terms govern access to and use of Domitienda, a platform operated by Comercializadora Web SAS (trade name: Cachalotlab), Colombian tax ID (NIT) 901.048.721, located at Carrera 53 # 75-138, piso 2, oficina 17, Barranquilla, Atlántico, Colombia ("Domitienda", "we", "us"). By creating an account, connecting Meta assets or using the platform, the customer business ("Client") accepts these terms. Anyone acting for a business represents that they are authorized to bind it.

Domitienda lets businesses connect WhatsApp Business Platform (Cloud API) phone numbers, manage the assets they authorize, and relay messages between WhatsApp and the Client's systems through the platform and its API. The available features are those shown in the product or in the commercial proposal accepted by the Client.

Domitienda may modify or withdraw features in order to maintain, protect or improve the service. When a change materially affects the contracted service, we will try to give the Client reasonable prior notice.

The Client must provide accurate information and keep it up to date, protect its credentials and API keys, and limit access to authorized people. The Client is responsible for activity carried out with its account and must notify us immediately if it suspects unauthorized access.

When connecting a Meta account, phone number or other asset, the Client authorizes Domitienda to access and process the data strictly necessary to provide the features the Client enables. The Client may withdraw that access in its Meta business portfolio settings. Disconnecting an asset may interrupt features that depend on it.

Use of the WhatsApp Business Platform and other Meta products is also subject to Meta's terms, policies and requirements. Meta is a third-party provider and Domitienda does not control its availability, decisions, product changes or policies.

The Client is responsible for:

  • complying with applicable law and WhatsApp and Meta policies;
  • having the authorizations and legal bases needed to collect and communicate personal data, and to send messages to its end users;
  • providing adequate privacy notices to its end users and handling their rights as controller of that data;
  • using the service lawfully, securely and without abuse;
  • verifying the accuracy, relevance and legality of the messages, files, templates and instructions it processes or transmits;
  • keeping its credentials, devices and connected systems secure, and notifying us of relevant incidents.

The Client must not use Domitienda to send unlawful, misleading or unauthorized communications or communications that infringe third-party rights, nor attempt to access systems or data without authorization.

The plan, included features, usage limits, fees, billing frequency and payment terms will be those stated in the offer, order or checkout screen accepted by the Client. No fee will apply unless it has been disclosed and accepted. Applicable taxes will be itemized or charged as required by law and the corresponding billing document.

Personal data processing is governed by our Privacy Policy (https://www.domitienda.co/privacy) (in Spanish: Política de Privacidad (https://www.domitienda.co/privacidad)). For data of Clients and their representatives, Domitienda acts as controller. For data of people who message a Client on WhatsApp, Domitienda acts as processor and the Client is the controller.

The Client instructs Domitienda to process end-user data in order to provide the service. When the contract ends, the Client may request export or deletion of that data by emailing privacidad@domitienda.co. Under the Privacy Policy, we will delete the corresponding data within 30 days, unless a legal obligation requires us to keep it.

Instructions for exercising rights and requesting deletion are at Data deletion (https://www.domitienda.co/data-deletion). End-user requests should first go to the business they messaged; if they reach Domitienda, we will forward them to the responsible Client and help respond.

Domitienda and its providers retain the rights in the platform, software, trademarks and associated materials. While the Client complies with these terms and its plan, we grant a limited, non-exclusive, non-transferable and revocable permission to use the service for its internal business purposes.

The Client retains the rights in its data and content. It authorizes us to host, transmit and process them only as needed to provide, protect and maintain the service, according to its instructions and the Privacy Policy.

We will use reasonable efforts to keep the service running and protected. Interruptions may occur due to maintenance, provider failures, networks, Meta services, security incidents or causes beyond our control. Support channels and hours will be those stated in the product or in the accepted commercial offer.

The Client may stop using the service and request account termination by emailing privacidad@domitienda.co. We may suspend or limit access when reasonably necessary to protect the platform or third parties, comply with the law, follow a Meta instruction or address a material breach of these terms. Where possible, we will notify the Client and give it a chance to cure the breach.

When the service ends, the export and deletion procedures described in the Privacy Policy and in section 5 of these terms will apply. Termination does not cancel payment obligations already incurred or records we must keep by law.

Domitienda is not liable for interruptions or decisions by Meta, WhatsApp, telecommunications operators or other services it does not control, nor for the content or instructions the Client sends through the platform. Each party is liable under applicable law for its own acts and obligations. Nothing in these terms limits liabilities that cannot legally be limited.

We will publish any change on this page and show the updated date. If a change materially affects the Client's rights or obligations, we will notify the email associated with the account with reasonable prior notice. Use of the service after the change's effective date constitutes acceptance, unless the law requires another form of consent.

These terms are governed by the laws of the Republic of Colombia. Disputes will be submitted to the competent authorities under the applicable legal rules.
